A Morgantown man, his mother and his friend are suing McDonald's for $10 million.

The man says he bit into a hamburger and had a severe allergic reaction to the cheese melted on it.

Jeromy Jackson, who is in his early 20s, says he clearly ordered two Quarter Pounders without cheese at the McDonald's restaurant in Star City before heading to Clarksburg.

His mother Trela Jackson and friend Andrew Ellifritz are parties to the lawsuit because they say they risked their lives rushing Jeromy to United Hospital Center in Clarksburg.

The lawsuit alleges Jeromy "was only moments from death" or serious injury by the time he reached the hospital.

"We're interested in seeing McDonald's take responsibility and change a systemic quality control problem that endangers the lives of up to 12 million Americans with allergies," said Timothy Houston, the Morgantown lawyer representing the plaintiffs.

Houston said his clients were in Morgantown in October 2005 and stopped at the Star City McDonald's on the way home to Clarksburg. Jeromy Jackson was living with his mother at the time.

Jeromy did his part to make it known he didn't want cheese on the hamburgers because he is allergic, Houston said.

He told a worker through the ordering speaker and then two workers face-to-face at the pay and pick-up windows that he couldn't eat cheese, Houston said.

"By my count, he took at least five independent steps to make sure that thing had no cheese on it," Houston said. "And it did and almost cost him his life."

After getting the food, the three drove to Clarksburg and started to eat the food in a darkened room where they were going to watch a movie, Houston said.

Jeromy took one bite and started having the reaction, Houston said. One of the three immediately called the McDonald's to let restaurant employees know they had messed up the order, but had to cut the call short when Jeromy started having a bad reaction, Houston said.

At least two managers at the McDonald's called the Jacksons afterward to apologize for what happened, Houston said.

McDonald's representatives offered to pay half of Jeromy's medical bills -- which totaled about $700. When Houston became involved, he said the company offered to pay all the medical costs.

The plaintiffs weren't interested, and McDonald's wasn't offering anything more than medical costs.

The Jacksons and Ellifritz filed the lawsuit on July 18 in Monongalia Circuit Court.

Houston didn't know if McDonald's had yet been served with the complaint.

The lawsuit seeks damages on two counts of negligence, one count of intentional infliction of emotional distress and one count of punitive damages.

The fast-food giant has been sued before.

In one notorious instance in 1992, Stella Liebeck, a 79-year-old woman from Albuquerque, N.M., sued McDonald's after she suffered third-degree burns from spilling a hot cup of coffee in her lap.

A jury later awarded Liebeck $2.9 million.

That just seems off. That must have been a really small piece of cheese for him not to see it. From what I see, a McDonald's cheeseburger has cheese practically running down its patty :|

this is justified, but the amount is still ridiculous big.
An allergic reaction can be very severe, people have been known to die from licking PEANUT BUTTER, one lick, and a conclusion of blood pressure rising, stroke, heart attack, lack of breath, andrenaline rush, all comes together and voila = death.

I personally don't like mcdonalds..in fact i hate them..lots of people there are either in high school or are droppouts from graduation(no offence if anyone works there for a job to just earn money for something).so they usually get orders mixed up and stuff put on your food that you don't want on there. basicly if you want something done right you gotta either do it yourself or beat the hell out of them until they do it right.

he won't win. if you ask for 'no something' on whatever. 99.99999% of people look at the sandwich or whatever before they eat it and take it off if its there. i'm pretty sure if this guy had an allergic reaction that is worth 10 million he would look down at his sandwich before eating it...gg

Well, if he did not want the cheese he could have ordered a couple of ordinary hamburgers, which have no cheese :/

Specific orders should only be used in high priced resturants instead of McDonald's drive-thru's!

Anyways, as bad as it is to get an allergic reaction, McDonald's apologized and offered to pay his whole medical bill.

Yes, it was the employee's fault, but jeez. Most are high school students. People make mistakes.

The guy's just wanting some money to blow.

The idiot should have expected a mistake, if you're allergic you always should, he should have checked his burger first, it's not that hard. People who have other allergies usually do it, why didn't he?

Eating a burger in a darkened room while watching a movie. Ask yourself, would you be more interested in the movie, or your burger? I'm not surprised that he didn't notice actually. He made it pretty clear that he didn't want cheese on his burger, so he probably thought that they got the point. :/

Nevertheless if he has such a serious allergy to cheese, so much so that it can do that much damage, he would have to be blatantly retarded to not look at it. All that can be blamed is his own stupidity.

Did he have a recipt that showed minus cheese?

Because if he didn't wouldn't it just be their word agains MCD's, and if it came down to that, the judge would probably just be like, accept the payment for medical bills and go away.

Also fast food places are notorious for messing up orders, from my experiences it like a 1 in 3 chance of your order being wrong. I have friends with severe allergies and they check thier order before the eat because they actualy have common since.

He should accept the money for the medical bill, and maybe a little extra, but $10,000,000 is just ridiculous.

hm... actually i have heard there was a kid who was allergic to peanut butter and one sniff was enough to send him to hospital and one lick was enough to kill him.

anyway, seems like this guy knew the threats well and know that his so-called allergy weren't severe enough to cause life-threatening situations. in all seriousness, he would have avoided mcdonalds and junk foods altogether but he's obviously going for the green. unfortunately, he had decided to make mcdonalds his cash cow. he will get money alright, but probably not all, but still a lot. this world has gone insanely wrong.

you'd be surprised. considering my older brother is allergic to certain kinds of foods, it's pretty damn scary seeing someone close to death when something as simple as a piece of food can screw over an entire family, regardless of what size.

to be honest i'm kind of surprised your guys aren't taking this a little more seriously, but who am i to tell you how to feel...........

in any case, frankly $10 million should be chump change for McD's anyway. if you take a look at the McDonald's entry on wikipedia, their total revenue is in excess of $20 billion dollars. they're just greedy ****s that don't care what happens to their customers.

alot of people can sometimes be clueless...spur-of-the-moment cluelessness i suppose. i work at the on-campus burger king at the college i go to and sometimes i'll see an order up for:

1 cheeseburger minus cheese

but essentially that's:

1 hamburger

orders like that can really mess up beginners and they wind up putting something in a sandwich that doesn't belong. in that respect stuff like that happens and you can't really stop it. i can respect that, but what i CAN'T stand is the fact that McD's is not being considerate of the situation the family has been put into.

Wow, that's crazy. I knew there were people who are super sensitive to some food, but I never expect someone to sue 10 million just for that! If he cared about his health so much, he should've checked BEFORE eating in a theatre. That's what I always do; I always check to make sure they got everything right before I leave the restaurant.

Also, this is also the dude's fault as well, because he was pretty careless. Nonetheless, Mac does share the blame, but 10 million is absolutely ridiculous.
